Kenneth E. Aldous

Kenneth E. Aldous is the founding member of Aldous pllc.  As an experienced lawyer qualified to practice in both the U.S. and UK, Ken has represented a broad range of diverse interests in complex litigation before various federal and state courts, as well as in domestic and international arbitration. 

Prior to founding Aldous pllc, Ken worked for twelve years as an associate in the Litigation & Dispute Resolution Department of Proskauer Rose LLP, focusing his general litigation practice on international, multi-jurisdictional and cross-border dispute resolution.  He also has significant in-house experience.



Ken's activities in both private and in-house practice have included a wide array of commercial disputes, including matters involving antitrust/competition law; telecommunications law; bankruptcy litigation; securities litigation; trade-secret, copyright/trademark and other forms of intellectual property protection; non-compete and employment-related issues; insurance; sports law; legal ethics; and other commercial disputes.  He also maintains an active pro-bono caseload.

A sampling of Ken’s matters includes in-depth representations of:

    • A French cellular telephone provider in federal-court litigation against a U.S. equipment supplier
    • The Hong Kong-based executive of a U.S. energy company in ICDR/AAA arbitration
    • A major U.S. news corporation in a construction dispute involving a state-of-the-art production facility
    • A U.S. pharmaceutical company in ICC arbitration against a European state over the expropriation of foreign investments

Ken also has significant experience representing clients in internal and regulatory investigations, including matters involving the Antitrust Division of the U.S. Department of Justice and various securities regulators.

During 2010, Ken served as in-house litigation counsel on secondment to NYSE Euronext, a preeminent global stock exchange and technology company, working closely with outside and in-house counsel to manage various litigation matters, including intellectual property cases and third-party discovery requests.  He also assisted with a brief to the U.S. Supreme Court in a high-profile international securities case.

During 2008-2009, Ken served on secondment as Head of Litigation & Employment for BT Americas Inc., a subsidiary of British Telecommunications plc.  In that role, he assumed responsibility as the primary in-house litigation counsel to a multi-billion dollar telecommunications company, undertaking substantive and case-management oversight for all litigation and employment matters in the U.S., Canada and Latin America.  Ken provided advice and assistance to UK-based counsel and supervised in-house attorneys based in Los Angeles and São Paulo, as well as external counsel located throughout the Americas.  In addition to a variety of disputes arising in a multi-jurisdictional and cross-border context, Ken’s responsibilities included matters involving:

    • Contracts for the provision of telecommunications, network and professional services
    • Post-closing warranty/indemnification claims arising out of M&A transactions
    • Insolvency and bankruptcy/administration proceedings, both in the U.S. and abroad
    • Wrongful termination, discrimination, non-compete and other employment-related claims
    • Patent, trademark and other types of IP-related claims
    • Antitrust/competition, trade regulation and unfair competition claims
    • Security/privacy matters
